ARTICLE 1: GENERAL PROVISIONS

Oyobar.be is the website of O’yo, with registered office at 82 Brabantdam, 9000 Ghent. VAT BE0641 908 386. This website offers its customers the opportunity to purchase the products from its online store online. These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the O’yo web store, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by O’yo.

ARTICLE 2: PRICE

All prices stated are expressed in EURO, always including VAT and all other taxes or taxes that are obligatory to be borne by the Customer. O’yo is subject to tax as a business. VAT applicable. If delivery, reservation or administrative costs are charged, this will be stated separately. The price indication refers only to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

ARTICLE 3: OFFER

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind O’yo. In terms of the accuracy and completeness of the information provided, O’yo is only bound by a means obligation. O’yo is in no way liable in the event of manifest material errors, typesetting or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact O’yo in advance via the email address. The offer is valid as long as supplies last and can be adjusted or withdrawn at any time by O’yo. O’yo cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

ARTICLE 4.1 PLACING ORDER

How to place an order?

You choose your favorite items and place them in your shopping cart.
To complete the order, click on ‘Shopping cart’ at the top right and go through the following steps in the ordering and payment process:
Enter your personal details or log in if you are already registered.
Choose the collection or delivery method
Select the desired payment method.
View your details one last time and finalize the order. < br /> After completion, the order will be confirmed by email and carefully processed.
O’yo is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

ARTICLE 4.2 AGE LIMITATION

Applicable law: on 31 December 2009, the Belgian Official Gazette amended the law on the age limits for selling and serving alcohol to young people. This concerns an amendment to the law of 24 January 1977 “on the protection of the health of users in the field of food and other products”. This amendment came into effect on 10/01/10. In essence, the amendment states the following: It is forbidden to sell, serve or offer alcohol to people under 16. Alcohol means all alcoholic drinks of more than 0.5% vol. including beer, wine,…. It is not allowed to sell, give or offer spirits to an 18-year-old. Any person wishing to purchase alcohol / spirits may be asked to provide proof of age
Customer declares that at the time of placing the order he has reached the minimum age of 18 years.
O’yo owns the right to cancel the order after the order has been placed by the Customer if it is suspected that the Customer has not reached the age at the time of the order. O’yo is not required to provide evidence for this. In this case, the Customer is entitled to a full refund.
If the Customer cannot demonstrate at the request of O’yo on delivery or collection that the minimum age of 18 has been reached, O’yo will not hand over the goods. In this case, the customer is entitled to a full refund.

ARTICLE 5: DELIVERY AND PERFORMANCE OF THE AGREEMENT

The ordered item is delivered in the Ghent zone. The delivery cost is 5 euros per address.
Orders can always be picked up at Brabantdam 82, 9000 Ghent.

Terms of delivery:

The goods are only made and / or shipped after payment has been transferred to our account. Deliveries are made on working days
You will be charged for any costs for returning to our address. Any visible damage and / or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately to O’yo by the Customer. The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk already transfers to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by the O’yo.

ARTICLE 6: RESERVATION OF PROPERTY

The delivered items remain the exclusive property of O’yo until the moment of full payment by the Customer.
The Customer undertakes to inform third parties if necessary of O’yo, eg to anyone who would seize articles that have not yet been paid in full.

ARTICLE 8: VALIDATION TO VALIDITY – NON-RENDERING

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. Failure at any time by O’yo to enforce or exercise any of the rights set forth in these Terms will never be construed as a waiver of such provision and will never invalidate those rights harm.

ARTICLE 9: CHANGE OF CONDITIONS

These Conditions are supplemented by other conditions that are explicitly referred to, and O’yo’s general conditions of sale. In the event of any inconsistency, these Terms and Conditions shall prevail.

ARTICLE 10: PROOF

The Client accepts that electronic communications and backups can serve as evidence.

ARTICLE 11: APPLICABLE LAW – DISPUTES

In the event of a conflict, O’yo and the Client will endeavor to find a mutually acceptable solution. Belgian law applies, with the exception of the provisions of private international law on applicable law. The courts of the Consumer’s place of residence have jurisdiction in legal disputes.
